Course overview

This course is designed to enhance the skills of government negotiators in ISDS, focusing on capacity building. By the end of the course, participants will be equipped to navigate ISDS matters and achieve better outcomes for their governments. Key areas of focus include understanding legal frameworks, honing negotiation skills, analysing real-world cases, and refining policy-making abilities. 

The first part of the course includes the following modules:

Module 1: The Art of Crafting Investment Policy: Interface Between Domestic Considerations & International Investment Law.  

Module 2: The Art of Negotiating Investment Treaties: Dynamics of the Negotiation Process & Regime Interaction in Public International Law.

Module 3: The Art of Negotiating in Investor-State Disputes: Strategic Approaches to Avoid Arbitration or Improve State Positioning. 

The second part of the course also features dynamic regional panels, each focusing on the unique challenges and opportunities in different parts of the world. From North America to Oceania, these panels provide a global perspective, equipping negotiators with the insights they need to tackle region-specific issues head-on.
